阿根廷升级航行安全和环保法规

近日，中国船东互保协会（中船保）收到阿根廷当地通代信息：阿根廷政府颁布一项新的关于航行安全和环保的法规（新“REGINAVE”法规）。在新“REGINAVE”法规下，作为阿根廷国家海事主管机关的海岸警卫队将实际行使对任何个人和船东因触犯阿根廷新“REGINAVE”法规行为的调查和处罚的权利，而且惩罚力度较前将大幅增加。　　新规出台背景　　阿根廷政府最早于1973年5月16日在第“4515号法令”中颁布关于航运安全和环保的法规REGINAVE（原“REGINAVE”法规），并明确阿根廷海岸警卫队对外籍船员或船东行使管辖权利。起初，阿根廷海岸警卫队对违法行为处罚力度不是很大，如果发现外籍船员违反原“REGINAVE”法规，仅需将违法行为通过外交手段通知其船旗国主管机关或船员证书签发主管当局，并没有过多地对外籍船员或船东进行罚款的行政处罚。2019年11月14日，阿根廷政府颁布新“REGINAVE”法规，并于2019年11月22日生效，相比原“REGINAVE”法规，新“REGINAVE”法规明显加大对外籍船员、船舶和船东的违法处罚，这将对船东及其保险人带来不利影响。　　明确行政处罚　　新“REGINAVE”法规重申，一旦发现外籍船舶及船员在阿根廷管辖水域发生违反航行安全和环保的行为，阿根廷海岸警卫队将有权对其处以罚款的行政处罚。　　阿根廷海岸警卫队有权滞留有违法行为的船舶，直到其收到相应的罚款或其认可的国家政府或实体机构提供的财务担保。　　新“REGINAVE”法规要求的担保包括：个人债券、资产支持证券（如现金）或其他能够被阿根廷海岸警卫队认可的有足够经济实力的财务担保。因此，目前尚不能确定第三方信誉担保“LOU”是否会被其接受。　　加大处罚力度　　新旧法规对违法行为的罚款处罚都以 “Unidades de Multa”（UM）为货币计量单位。在过去，每一UM兑换1.5阿根廷比索，而原“REGINAVE”法规的最大罚款处罚为6万UM，相当于9万阿根廷比索，按目前汇率约合1500美元；如今，由于阿根廷国内通货膨胀，每一UM已经兑换为10阿根廷比索，而且在新“REGINAVE”法规下，最大的罚款金额可高达300万UM，相当于3000万阿根廷比索，约合50万美元。而且，UM对阿根廷比索的汇率将根据阿根廷国家统计机构公布的通胀率逐年调整。　　船东连带责任　　在原“REGINAVE”法规中，船东和船员的责任是分开的，如果违法行为的主体仅仅是船员本身，则船东将不被追究连带责任。但是在新“REGINAVE”法规下，船东有可能要为其代理人的侵权行为负责。这就意味着，如果在船东船舶上服务的船员违反新“REGINAVE”法规，船东将一起承担连带责任。　　协会防损建议　　阿根廷是拉美第三大经济体，具有丰富的自然资源，也是矿产、农业和渔业出口大国。阿根廷主要的外贸出口港大多集中在河道内，因此，结合目前中船保收到的新“REGINAVE”法规的初步意见，以及近年来中船保协助处理的船舶在阿根廷水域的安全事故，建议计划前往阿根廷港口的船舶应注意下述几点：　　一是在阿根廷沿岸航行，船舶污油水和生活垃圾及货舱洗舱水的排放应严格遵守国际公约和阿根廷国家法律法规，特别是在国际海事组织的2020限硫令生效后，船舶更应注意使用合规燃油以符合硫化物和氮化物排放标准，同时遵守脱硫塔的使用规范。　　二是阿根廷河道内的港口，距离外海很远，需要很长时间的引航作业。因此，船长应合理安排值班，谨防船员疲劳，并注意控制好船长自身的疲劳，并监督引航员防疲劳。　　三是阿根廷河道狭窄、水流湍急、交通繁忙，船长应确保驾驶团队尽职尽责，严格执行操船指令并密切监督引航员的操作。　　四是由于阿根廷某些港口航道过长，再加之港口拥挤，船舶很可能在航道中路抛锚待泊。船长应严格安排甲板机舱锚泊值守，严防在河道中走锚进而发生碰撞、触碰和搁浅等事故。　　五是阿根廷当地引航员通常会借助潮流作用，在船舶靠离泊操作中只雇佣一艘拖轮协助操作。鉴于新“REGINAVE”法规对航行安全和环保的处罚力度加大，船东应提前与租家沟通，在租船合同中写明增加拖轮数量以协助船舶安全靠离泊。　　六是阿根廷港口国检查较严，船长应组织做好船舶安全自查工作，以顺利通过港口国检查。如果船舶被查出有关航行安全和环保缺陷，船舶不但可能被滞留，而且船东和责任船员也可能根据新“REGINAVE”法规遭受罚款处罚。　　七是船东应根据体系文件的相关要求，在船舶到港前给予船长在航行安全和环保方面必要的技术支持，以履行在《国际安全管理规则》要求下，船东对船舶的安全监管责任。
